What type of fund can you file a QDRO on?

I had a divorce last year that was finalized on the 13th of December, 2007. My X and I had to liquidate his IRA to disolve the marriage. I needed to cash out my portion of the IRA to pay bills. He was sent the 1099 in his SS# because the firm that held the annuity did their paperwork incorrectly, which now they are trying to get me to set up an account to fix all of these mistakes. I had agreed to pay the taxes on. I was told that the Qdro would allow us to avoid a penalty. My accountant told me that the type of account my husband had doesnt qualify for exemption of penalties and the QDRO (filed through the courts) is not applicable. Who do I talk to to confirm this. I dont want huge penalties on my taxes and I dont think I should be responsible for the penalties anyway. Do I need an attorney and if so what kind?
