I lived in ny my whole life had a little girl very young but went to school got my degrèe and fell in love and got married i gavé him a heads up the

Ive lived in ny my whole life had a little girl very young but went to school got my degrèe and fell in love and got married i gavé him a heads up the Summer before i left becaúsë of my fiances orders
I have been living in tn for about a year now.i am married and would like to know what my chances of obtaining soul custody of my daúghter are.her bio lives in nyc .hê has never supported her since birth Even but now hê all of a súdden wants to see her and be with her but when i was in ny seèing her was no priority to him but now is hê is in a gang proud of it and claims to see deámons and is often tellin me how depressed hê is and is going to end his life becaúse its not worth it i have a violent past with him which has been documented but i was álways gulláble to drop the case i honestly would hate for all this to go into Court but i am a mom first her rightful place is with me can you pleáse help what are my chances of obtáing sòul custody Doès my husband.need parentsl Rights?

Your present husband only has the rights that you give him,legally he has no rights,if he is willing to adopt your child and you can get the father to sign over his rights then you could do this. If you both decide to do this then you cannot get any child support from the father. He would lose all of his rights. You can file for child support and get it from the father,he may willing to sign over his rights in order to get out of child support. However if he is on the childs birth certificate he has legal rights to file for visitations,and if he is not then he has no legal rights until he takes a DNA to prove parenty,and then if he is the father he can file for visitations. He is not going to get custody of your child,however if you have never filed for custody though the court then you need to do so,until the court grants you legal custody you do not have it.
